
(ProsperNews.net) – The US Supreme Court has granted partial immunity to Donald Trump and ruled that he cannot face prosecution for official Presidential acts. The former President’s attorneys have sought immunity since Special Counsel Jack Smith charged their client with various offenses connected to the 2020 Presidential election and his alleged attempts to interfere with and overthrow the result. The case will now return to lower courts to determine which of Trump’s acts are official and, therefore, covered by immunity and which are not.
Chief Justice John Roberts, explaining the 6-3 ruling, stated that America has never before had to question the criminal immunity available to a President and must strike the right balance. He noted that while the President cannot be above the law, nor can he face prosecution or the threat of prosecution for carrying out complex Presidential duties and making highly consequential decisions.
Dissenting Justices, however, said the decision was misguided and fundamentally changed the nature of the US Presidency. Justice Sonia Sotomayor said the ruling mocked “the principle that no man is above the law.” She told her Supreme Court colleagues they had created an America of “kings” and questioned where the limits to Presidential power now lie.
Legal experts say that Jack Smith must now revisit the indictment, restructure his arguments, and review all evidence. Some suggest he may even be forced to drop the indictment.
President Biden reacted furiously and called a press conference at the White House. The President said the Supreme Court decision undermined the rule of law and effectively allowed Presidents to do whatever they wished without consequence. Biden told reporters that a “dangerous precedent” was set, which was a “terrible disservice” to the American people.
Mr. Trump celebrated the significant victory on his Truth Social media account, declaring he was proud to be an American. He added that the Supreme Court had upheld the spirit of the Constitution and described the ruling as a “big win.”
