According to the lawsuit’s originators, a liberal group known as Free Speech For People, Trump’s actions regarding the infamous January 6th incident are an example of insurrection and disqualify him from public office. Trump openly criticized the lawsuit by calling it a “hoax” and celebrated its dismissal on his social media platform, Truth Social. However, the Minnesota lawsuit isn’t the only suit against Trump aiming to end his appearance on the primary ballot.
Another lawsuit attempting to keep Donald Trump off a state’s ballot is unfolding in Michigan, where activists are suing Michigan’s Secretary of State Jocelyn Benson to force her into removing Trump from the state’s presidential primary ballot. The Michigan lawsuit also refers to the insurrection clause from the 14th Amendment. Free Speech For People is involved in the Michigan lawsuit, and the group claims it will work diligently to prevent Trump from appearing on state ballots. Benson claims she lacks the authority to remove Trump from Michigan’s state ballots, and the decision requires the Michigan Court of Claims to consider the legality of such a measure. Benson confirmed that she’d adhere to the court’s ruling, regardless of how it determines the suit’s outcome.
The effort to remove Trump from state ballots is also unfolding in Colorado, and the trial to determine a potential disqualification for the former president is underway. Each lawsuit centers around the aforementioned insurrectionist clause from the 14th Amendment, and legal scholars expect the United States Supreme Court to consolidate the cases and provide a definitive ruling.
The Supreme Court has never heard a case regarding Section 3 of the 14th Amendment, making the lawsuits a historic legal battle with massive ramifications for the United States moving forward. The lawsuits against Trump will likely fail if the Supreme Court takes the cases, as Trump hasn’t been convicted for insurrection and maintains a strong support base in Congress and among American citizens.
