Judge Won’t Let Trump Be Removed from Ballot

(ProsperNews.net) – A Wyoming judge has rejected calls to ban President Trump from the state’s primary ballots. Albany County District Judge Misha Westby rejected arguments that the former President is disqualified from office because he is in violation of the 14th Amendment to the Constitution which prohibits those who have engaged in insurrection from holding high office in Washington, DC.

In her ruling, Judge Westby said, “Making a determination at this stage of the process would be imprecise, subject to speculation, and would create rather than diminish future controversies.”

Republicans celebrated the ruling, which followed a lawsuit filing by retired Laramie attorney Tim Newcomb, who argued that Trump should be excluded from the White House race. Newcomb hoped that Wyoming would follow in the footsteps of Colorado and Maine, who have both expelled Trump. The former President is appealing those decisions in the US Supreme Court.

Mr. Newcomb also sought to remove US Senator Cynthis Loomis from ballot papers, even though she is not due for re-election until 2026. He targeted Senator Loomis for refusing to “count Pennsylvania’s electoral ballots to the electoral count.” A spokesperson for the Senator dismissed the lawsuit as “frivolous.”

On January 7, 2021, Senator Loomis issued a statement saying she had serious concerns about the integrity of the 2020 Presidential election result – particularly in Pennsylvania – and said she had expressed these in a statement to the Senate. However, the “sickening, un-American attack on the US Capitol overshadowed that debate,” she said.

Loomis called for a federal investigation into election integrity across the states and said the “allegations of fraud during this election were unprecedented.”

Wyoming Secretary of State Chuck Gray said he was delighted by Westby’s ruling and issued a press release saying he would work tirelessly to ensure that President Trump appears on Wyoming’s ballots and “continue to fight against this nationwide effort in order to protect the integrity of our elections.” He described Newcomb’s lawsuit as “outrageously wrong.”
